As someone who has devoted himself to the worlds of performance and education for over three decades, I have learned an important lesson about communication – the words we speak are not as informative as the way in which they are expressed and equally important, the context in which they are spoken and heard. I have experienced this firsthand as an actor, director and consultant.
The fact that actors and audience share the same space at the same time during a theatre performance distinguishes it from film, television, and other forms of media. Theatre is a live event, and taps into our primitive storytelling roots. An attorney presenting their client’s case to a jury more closely resembles a live theatre performance than a film or tv show.
20 years ago while developing my method for communicating more effectively, I sat in on dozens of jury trials, taking copious director-style notes on attorneys’ courtroom performance with the express purpose of developing this method to improve the quality of attorneys’ communication with jurors.
To that end, I witnessed many parallels between acting/directing techniques, and effective courtroom communication. Persuasion Arts in Action, Top 10 Performance Competencies for Attorneys is the result of many years of research and application of these techniques.

Marc Bauman is a nationally recognized instructor who has successfully consulted attorneys in Arizona and California, assisting them in courtroom communication skills in the areas of case analysis, jury selection, opening statement, case-in-chief presentation and closing argument. He has consulted in both criminal and civil cases in the areas of Anti-Trust, Child Abuse, Contract Law, Insurance Bad Faith, Medical Malpractice, Personal Injury, Wrongful Death, and Wrongful Termination.
Mr. Bauman is a frequent presenter at the State Bar of Arizona where his CLE course, Persuasion Arts In Action, Top 10 Performance Competencies for Attorneys has garnered top survey scores. He has designed curriculum that has been accredited by the University of California and has developed and implemented change initiatives in companies resulting in improved interdepartmental communication and increased profitability. His background includes over 20 years of teaching, acting, directing and presenting seminars internationally at top-ranked universities, colleges and schools including Arizona State University, University of California at Los Angeles, University of Southern California, American Conservatory Theater and Deerfield Academy. He is a 3-time honoree in Who’s Who Among America ‘s Teachers (2002, 2005, 2006) and has appeared professionally in numerous theatre productions, film and television. Mr. Bauman has held professional memberships in American Society of Trial Consultants, Actors Equity Association, AGMA and is a member of SAG-AFTRA.
